Tesiup - Terms of Service

1. Introduction

Welcome to Tesiup. These Terms of Service ("Terms") govern your access to and use of Tesiup's website, products, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Service.

2. Acceptance of Terms

By accessing, using, or making a purchase through Tesiup, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

If you use the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Description of the Service

Tesiup is an AI-powered website analysis tool that evaluates websites across key pillars such as user experience, design, trust, and conversion.

The Service includes:

  • Free Analysis (Free): a basic evaluation that provides an overall score and key highlights.
  • Deep Analysis (Paid): a more comprehensive evaluation with pillar-level insights and a prioritized improvement plan, available as a one-time purchase per URL for $8 USD (or the price shown at checkout).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you to the extent permitted by applicable law.

4. Eligibility

You must be at least 13 years old (or 16 in the EEA, if applicable) and have the legal capacity to enter into these Terms. By using the Service, you represent and warrant that you meet these requirements.

5. Accounts and Access

The current version of Tesiup may allow usage without an account. If accounts are introduced in the future, you agree to provide accurate information and keep it up to date.

You are responsible for all activity associated with your access and for maintaining the confidentiality of any credentials or private links related to your use of the Service.

6. Use of the Service and Restrictions

You agree not to use the Service in any way that:

  • Violates any applicable laws or third-party rights.
  • Attempts unauthorized access to systems, data, or infrastructure.
  • Interferes with the Service, performs abusive automation, mass scraping, or bypasses limits.
  • Uses the Service to create or promote illegal, harmful, or deceptive content.
  • Introduces viruses, malware, or malicious code, or attempts to disrupt or degrade the Service.

We may limit, suspend, or block access if we detect abuse, fraud, abnormal patterns, non-payment, or usage that could harm the Service or third parties.

7. User Content

"User Content" includes information you provide while using the Service, such as URLs, prompts (if applicable), and any text or material you submit.

You represent and warrant that you have the rights to submit User Content and that it does not violate third-party rights or applicable law.

8. Intellectual Property

Tesiup and its licensors retain all rights, title, and interest in and to the Service, including its technology, brand, interface, design, algorithms, internal prompts, evaluation structures, and documentation.

Nothing in these Terms grants you ownership rights in the Service beyond the limited right to use it as permitted by these Terms.

9. AI-Generated Output

9.1 Ownership and Use of AI Output

Content generated by the Service based on your inputs, URLs, and analysis context ("AI Output") is provided to you for your use. Subject to these Terms, you may use, reproduce, modify, and distribute AI Output, including using it as a basis for deliverables such as audits, redesign briefs, copy drafts, implementation checklists, and internal documentation.

9.2 No Guarantees on AI Output

We do not guarantee that AI Output will be accurate, complete, reliable, or fit for any particular purpose. AI Output may contain errors, omissions, inconsistencies, or recommendations that are not appropriate for your specific situation.

We do not guarantee that AI Output will be original, non-infringing, consistent, or reproducible. Due to the nature of AI systems, similar inputs may produce similar outputs across different users.

You are responsible for reviewing, validating, and testing AI Output before relying on it, publishing it, implementing changes, or using it in production or commercial contexts.

9.3 Similar Output for Different Users

Because AI systems learn patterns, different users may receive similar or identical outputs, even if they are unrelated. You acknowledge that such similarity does not imply copying and does not create liability for Tesiup.

10. No Professional Advice

Tesiup provides an AI-assisted diagnostic and structured audit to help you evaluate UX, design clarity, trust signals, and conversion friction. The Service does not provide professional advice and is not a substitute for qualified design, legal, technical, or business consulting.

You remain solely responsible for how you interpret and apply the analysis, and for any decisions, changes, or outcomes that result from using the Service. You should consult qualified professionals as needed before implementing changes that materially affect your business, compliance, or user experience.

11. No Guarantees of Results

Tesiup does not guarantee improvements in conversion, revenue, SEO rankings, business performance, or any specific outcomes.

Any examples, percentages, or results shown on the website are illustrative and do not constitute a promise of results.

12. Payments

Deep Analysis is a one-time purchase per URL for $8 USD (or the price shown at checkout). Payments are processed through Stripe or the payment processor available at the time.

By purchasing, you authorize the applicable charges and acknowledge this is a per-URL purchase, not a subscription.

13. Refunds

Except where required by applicable law, all purchases are final and non-refundable.

If a technical error attributable to Tesiup prevents delivery of the purchased service, we may, at our discretion, retry delivery, reissue the report, or provide a reasonable adjustment.

14. Third-Party Services

The Service may rely on third-party providers (e.g., infrastructure, analytics, hosting, payments). Tesiup is not responsible for outages, interruptions, or failures caused by third parties outside of our control, to the extent permitted by applicable law.

Third-party services may have their own terms and policies, and your use of those services is governed by their respective terms.

15. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if we believe you violate these Terms, misuse the Service, attempt to evade limitations, or if your use poses risk to the Service or others. We may also suspend or terminate the Service itself at any time.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESIUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, RELIABILITY, AND RESULTS.

TESIUP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUT WILL BE ORIGINAL, UNIQUE, CONSISTENT, OR NON-INFRINGING.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESIUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY RELIANCE ON AI OUTPUT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESIUP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TESIUP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

Some jurisdictions do not allow certain limitations, so this section may not fully apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless Tesiup from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of applicable laws or third-party rights.

19. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

20. General Provisions

If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Failure to enforce any right or provision will not be considered a waiver of that right or provision.

These Terms constitute the entire agreement between you and Tesiup regarding the Service, together with our Privacy Policy and any other policies referenced herein.
